Agreement to Terms

By downloading, accessing, or using Pepé ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the App.

Description of Service

Pepé is a mobile application designed to help couples organize their relationship by providing features including:

• Shared calendar and event planning
• Partner connection and synchronization
• Restaurant discovery and reservation links
• Shared grocery lists and wishlists
• Memory creation and storage
• Date night ideas and meeting scheduling

Eligibility

You must be at least 13 years of age to use Pepé. By using the App, you represent and warrant that you meet this age requirement. If you are under 18, you represent that you have your parent or guardian's permission to use the App.

Account Registration

To use certain features of the App, you must create an account using Apple Sign-In, Google Sign-In, or email authentication. You agree to:

• Provide accurate and complete information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized access
• Accept responsibility for all activities under your account

Partner Connection

Pepé allows you to connect with a partner to share calendars, lists, and preferences. By connecting with a partner, you acknowledge that:

• Shared content will be visible to your connected partner
• Either partner may disconnect at any time
• You are responsible for only connecting with individuals you trust
• We are not responsible for disputes between connected partners

Acceptable Use

You agree not to use the App to:

• Violate any applicable laws or regulations
• Harass, abuse, or harm another person
• Share content that is illegal, offensive, or infringes on others' rights
• Attempt to gain unauthorized access to the App or its systems
• Interfere with or disrupt the App's functionality
• Use the App for any commercial purpose without our consent
• Create multiple accounts for deceptive purposes

User Content

You retain ownership of content you create within the App (events, lists, photos, notes). By using the App, you grant us a limited license to store, process, and display your content solely for the purpose of providing the service to you and your connected partner.

You are solely responsible for the content you create and share. We do not monitor user content but reserve the right to remove content that violates these Terms.

Third-Party Services

The App integrates with third-party services including:

• Google Places API for restaurant discovery
• OpenTable, Resy, and Yelp for reservations (external links)
• Apple and Google for authentication
• Supabase for data storage

Your use of these services is subject to their respective terms and privacy policies. We are not responsible for the content, policies, or practices of third-party services.

Intellectual Property

The App, including its design, features, and content (excluding user-generated content), is owned by Pepé and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the App without our express permission.

Disclaimer of Warranties

The App is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that the App will be uninterrupted, error-free, or secure. We disclaim all warranties including, but not limited to, merchantability, fitness for a particular purpose, and non-infringement.

Limitation of Liability

To the maximum extent permitted by law, Pepé and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App. Our total liability shall not exceed the amount you paid for the App in the twelve months preceding the claim.

Indemnification

You agree to indemnify and hold harmless Pepé and its affiliates from any claims, damages, losses, or expenses arising from your use of the App, violation of these Terms, or infringement of any third-party rights.

Termination

We may suspend or terminate your access to the App at any time for violation of these Terms or for any other reason at our discretion. You may delete your account at any time through the App settings. Upon termination, your right to use the App ceases immediately.

Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms in the App or on our website. Your continued use of the App after changes are posted constitutes acceptance of the revised Terms.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles.
